Social and Political Expression as Protected Activity for Employees in Non-Union Workplaces

Employee rights to engage in Protected Concerted Activity continue to evolve and develop under the NLRA. This session will discuss the current state of protected concerted activity, as viewed by the NLRB and its General Counsel (GC Memorandum 21-03: Effectuation of the National Labor Relations Act Through Vigorous Enforcement of the Mutual Aid or Protection and Inherently Concerted Doctrines), including a review of recent cases addressing protected concerted activity as political and social justice advocacy for non-union employees.
