ESI’s human factors and trucking experts will discuss fatigue and drowsy driving in the trucking industry. Trucking topics include hours of service regulations (HOS) and trucking company responsibilities for preventing fatigue. Human factors topics include the science of fatigue and sleep deprivation, HOS violations vs. the science of fatigue, and human factors methods for investigating fatigue-related collisions. The experts will use defense case examples throughout the presentation to demonstrate the relevance of both trucking and human factors expertise in drowsy trucking cases.
Dr. Nancy Grugle is a board-certified Human Factors Professional (CHFP) with over 20 years of academic, industry, and forensic experience in human factors engineering. She applies her expertise to forensic casework involving motor vehicle collisions, product design, and premises safety. Dr. Grugle’s areas of specialization include fatigue, sleep deprivation and drowsy driving as well as distracted driving, looming, visibility/conspicuity and driver actions. Dr. Grugle has conducted hundreds of forensic investigations on cases involving these issues as well as cases involving expectancy and positive guidance, driver assistance technologies, and work zone safety.
Dr. Grugle’s research has been published in national and international peer-reviewed journals and she has given numerous presentations to legal organizations on the science of human factors and its application to forensic investigations.
Dr. Grugle conducts investigations for both plaintiff and defense counsel and has testified in both state and federal courts.
Transportation Safety Expert James E. Lewis, M.Ed., CDS has been working as an expert witness in the trucking & transportation industry for more than two decades. He obtained his Class A commercial driver's license in 1987 and boasts more than two million no-fault accident-free miles to show for his efforts. He has served as a transportation terminal manager, safety director, truck driver trainer, and owner/operator. He founded his own full-service freight brokerage. On the automotive side, he has been a service manager, sales manager, finance director, and fleet/commercial sales manager.
James' extensive background in transportation has seen him qualified as an expert witness in federal, state, and local courts specifically in the fields of towing and recovery operations and policies, DOT/FMCSA-governed trucking/transportation, general transportation operations and safety policies and procedures. James has also served as an expert in the automotive industry in the fields of lemon law, vehicle financing and leasing, dealership fraud, breach of warranty, diminution in vehicle value, automotive repair and maintenance, dealership service and sales policy and the appraisal of automobiles, recreational vehicles, medium and heavy-duty trucks, motorcycles and watercraft.
In addition to being the primary expert in several Federal-level class action suits, he has produced more than 12,000 written opinions, has testified in trials, mediations, and arbitrations over 800 times, and has been deposed 167 times.
