Virtual reality (VR) is a powerful and effective tool that is gaining use throughout the course of litigation. In many cases it is valuable early in an investigation when all stakeholders can benefit from a common view of a scene or piece of equipment. Early access to 3D data collected by laser scanners or drones can even be accessed remotely. Users who are physically distant can come together in a virtual space and interact with the 3D data together, moving independently in the virtual space, collecting measurements, inserting points of interest, and communicating verbally. Evidence-based VR is the most powerful and robust visual communications technology available today and it is poised to have an effect on the litigation industry for years to come. Of course, admissibility concerns are paramount when employing these technologies, and careful consideration must be given to the foundation for 3D visuals and how the courts engage with this technology. Controlling remote access to data is also an important legal consideration. By leveraging data-driven VR, clients, jurors, and judges have access to a deeper level of visual understanding. Witness, driver, pilot, and accident victim perspectives come to life in VR. The presenters will describe and critique the use of VR through technical and legal lenses, providing best practices and hazards that legal teams should consider when deploying VR in the course of litigation.
